These General Terms and Conditions govern the relationship between "The Magic of the Bulgarian Rose" Ltd. (hereinafter referred to as "the Merchant", "we") and the users of the online store bulgarianrosemagic.bg (hereinafter referred to as "the Website").

By placing an order through the Website, the user declares that they are familiar with these General Terms and Conditions and agree to them.

2. Products and Prices

The products offered on the Website are handmade jewelry and decorative items made from real, metallized, and 24-karat gold or 999 silver-plated plants. Each item is unique — slight differences in shape, size, and shade compared to the photos on the Website are possible due to the natural character of the material.
All prices on the Website are in euros (EUR) and include VAT, unless explicitly stated otherwise.
The Merchant reserves the right to change product prices at any time, with the change not affecting already confirmed orders.

3. Order and Payment

An order is considered placed after filling in the necessary data and confirmation by the customer during the checkout process.
Accepted payment methods: online by card (Shopify Payments) and cash on delivery (cash to the courier upon delivery), when this option is available.
After placing an order, the customer receives an email confirmation.

4. Delivery

Deliveries are carried out by Speedy (Izprati.BG) to an address or a courier office, as chosen by the customer.
Delivery time: usually 3 to 5 business days for Bulgaria, after order confirmation. For deliveries outside Bulgaria, delivery times may be longer, depending on the destination.
Delivery cost: according to the rates shown at the completion of the order. The Merchant may offer free delivery above a certain order value.
In case of impossibility of delivery (incorrect address, failure to receive the shipment, etc.), the Merchant will contact the customer to clarify a new term or conditions.

5. Right of Withdrawal from the Contract

In accordance with Art. 50 of the Consumer Protection Act, the consumer has the right to withdraw from the concluded distance contract, without stating a reason, without owing compensation or penalty and without paying any costs other than those specified in Art. 54, para. 3 and Art. 55 of the CPA, within 14 (fourteen) days, starting from the date of:

receipt of the goods by the consumer, when the order consists of one item;
receipt of the last item, when the order consists of several separate items.

How to exercise your right of withdrawal: Withdrawal is exercised by a written statement to the Merchant (by email to tmobrose@gmail.com or by phone 0896 746 012), unequivocally stating the decision to withdraw from the contract. You may use the sample form below, but this is not mandatory.

Costs of withdrawal: The costs of returning the goods are borne by the consumer. The returned goods must be in their original condition, packaging, and with all accompanying documents (certificate, etc.), without signs of use.

The Merchant refunds all amounts received from the consumer within 14 days from the date on which they were informed of the decision to withdraw, but not before receiving the goods back or proof that they have been sent back.

Exceptions: The right of withdrawal does not apply to goods made to the consumer's individual order or clearly personalized for them (e.g., products from the "Bespoke / Custom Order" category), in accordance with Art. 57, item 3 of the CPA.

6. Complaints and Warranty

The consumer has the right to file a complaint for any non-conformity of the goods with the sales contract, in accordance with the Consumer Protection Act. Complaints are accepted by email tmobrose@gmail.com, and it is advisable to attach photos of the defect and order details.

7. Online Dispute Resolution

In accordance with Regulation (EU) No 524/2013, consumers can use the European Commission's online dispute resolution platform: ec.europa.eu/consumers/odr.

8. Intellectual Property

The content of the Website — texts, photos, logos, design — is the property of "The Magic of the Bulgarian Rose" Ltd. and is protected by the Copyright and Related Rights Act. Copying and distribution without explicit written consent are prohibited.

9. Amendments to the General Terms and Conditions

The Merchant reserves the right to change these General Terms and Conditions at any time, with the changes becoming effective upon their publication on the Website.
